Does my tree have a TPO?

Under the Town and Country Planning Act 1990, certain trees are subject to Tree Preservation Orders (TPOs). Before any works can be carried out on TPO protected trees, permission must be obtained from your local planning authority (LPA) by submitting a formal application. Owners of protected trees are responsible for their care and maintenance, and are liable for any actions taken against them resulting in damage.

If you are unsure whether a TPO applies, there are various ways of getting this information: 


Conservation Areas

A conservation area is an area of special historical or architectural interest that is designated with the intend to preserve or enhance, and certain restrictions with regards to tree work exist in these areas. If a tree within a conservation area is already protected, regular procedures apply. However, if a tree in a conservation area is not covered by a TPO and is of a certain size, the relevant LPA must be notified of any proposed work at least six week before the work begins.
